QROPS India Eligibility: Who Can Transfer a UK Pension to India?
Eligibility for a UK-pension-to-India QROPS transfer is determined by the pension being transferable, the receiving Indian scheme meeting QROPS conditions, the member’s circumstances and the tax/advice rules. Being an Indian citizen or OCI holder by itself does not make a transfer eligible or ineligible; residence and pension type are more important.
Eligibility checklist
You normally start by confirming that you hold benefits in a UK registered pension scheme capable of being transferred. Defined contribution pensions and SIPPs are often structurally easier to assess than safeguarded-benefit arrangements, but the provider’s rules and transfer rights must be checked in every case.
The receiving pension scheme in India must meet the relevant requirements for a recognised overseas transfer. Check the current HMRC ROPS notification list at the time of transfer rather than relying on an old product list or brochure.
Residence and the 25% charge
Residence is important because one of the principal Overseas Transfer Charge exemptions applies where the member is resident in the same country in which the QROPS is established. The member must also consider the available Overseas Transfer Allowance.
DB pensions need a separate suitability decision
A cash-equivalent transfer value does not mean a DB pension should be transferred. A DB pension can provide guaranteed lifetime income and inflation protection. The FCA and The Pensions Regulator say keeping a DB pension is in most people’s best interests. For most safeguarded-benefit transfers above £30,000, regulated UK advice is mandatory.
Frequently asked questions
Do I have to be an Indian citizen?
Citizenship is not the key test. Pension type, scheme rules, receiving scheme and tax residence are more relevant.
Can I apply before moving back to India?
The timing of residence can materially affect the Overseas Transfer Charge. Obtain case-specific advice before initiating a transfer while resident in another country.
Can I transfer after age 55?
Age alone does not prevent a transfer, but benefit-access status, scheme rules and tax consequences must be reviewed.
