Can I Transfer My UK Pension to India? QROPS Guide for Returning Indians
A UK private or workplace pension may be transferable to an India-based Qualifying Recognised Overseas Pension Scheme (QROPS), but it is not automatic. The receiving scheme must satisfy the QROPS conditions, the UK scheme must permit the transfer, and the member must consider the Overseas Transfer Charge, Overseas Transfer Allowance, pension type, advice requirements and tax residence.
What a QROPS transfer actually does
A QROPS transfer moves eligible UK pension rights from a UK registered pension scheme to an overseas pension scheme that meets the relevant UK tax conditions. For someone who has returned permanently to India, an India-based QROPS can bring retirement assets into the country where the person expects to live, spend and plan retirement.
HMRC’s published ROPS list is a notification list, not a recommendation or guarantee. Before a transfer, the UK provider and member must still satisfy themselves that the receiving arrangement qualifies and that the transfer is a recognised transfer.
The five checks before you start
First identify the pension: defined contribution, SIPP, workplace money-purchase, defined benefit/final salary, or another arrangement. Second confirm whether the UK scheme offers a transfer and obtain the current transfer value. Third identify a suitable India-based receiving scheme that is on the current HMRC ROPS notification list and accepts the transfer. Fourth review the Overseas Transfer Charge and the member’s available Overseas Transfer Allowance. Fifth check whether regulated UK transfer advice is required, particularly where safeguarded benefits are involved.
For an India-resident member transferring to an India-based QROPS, the 25% Overseas Transfer Charge will generally not apply where the relevant residence exemption is met and the transfer is within the member’s available Overseas Transfer Allowance. That does not mean the entire transaction is ‘tax-free’ in every respect.
Why tax residence matters
The residence test is central. A transfer that is exempt because the member lives in the same country as the QROPS can become chargeable if circumstances change during the relevant five-year period. Members should therefore tell the scheme if they move countries and obtain tax advice before making a material change in residence.
What QROPS Direct can coordinate
QROPS Direct can help a returning Indian map the pension type, request and review transfer paperwork, coordinate with the UK provider and Indian receiving scheme, track the documentation and explain the practical steps. Where UK-regulated pension-transfer advice or specialist tax advice is required, that should be obtained from the appropriately authorised professional.
Frequently asked questions
Can every UK pension be transferred to India?
No. Transferability depends on pension type, scheme rules, statutory rights and the receiving scheme. State Pension rights are not moved through QROPS.
Will I automatically pay 25% tax?
No. The Overseas Transfer Charge depends on the facts. An India resident transferring to an India-based QROPS can fall within an exemption, subject to the available Overseas Transfer Allowance and other requirements.
Is an HMRC-listed scheme ‘approved’ by HMRC?
Do not describe it that way. HMRC publishes schemes that have notified it that they meet the conditions and asked to be included; inclusion is not a guarantee or recommendation.
